PUPPY PURCHASE AGREEMENT
[KENNEL / BREEDER NAME]
Date: [DATE]
==============================================
1. PARTIES
This agreement is made between [KENNEL / BREEDER NAME] ("Seller") and [BUYER NAME], residing at [BUYER ADDRESS] ("Buyer"), for the sale of the dog described below.
2. THE PUPPY
Breed: [BREED]
Sex: [MALE / FEMALE]
Color / markings: [DESCRIPTION]
Date of birth: [DATE OF BIRTH]
Microchip #: [MICROCHIP NUMBER]
Sire: [SIRE NAME]
Dam: [DAM NAME]
Registration: [REGISTRY AND NUMBER, IF ANY]
3. PURCHASE PRICE AND DEPOSIT
The total purchase price is $[PURCHASE PRICE].
The Buyer has paid a deposit of $500, which is applied toward the purchase price. This deposit is non-refundable; however, if the Buyer's preferred puppy is unavailable, or if the Buyer elects to wait, the deposit may be transferred once to a future litter at the Seller's discretion.
The remaining balance is due on or before the day the Puppy leaves the Seller's care. Payment of the balance must be made in [ACCEPTED PAYMENT METHODS].
4. VETERINARY EXAMINATION
The Buyer agrees to have the Puppy examined by a licensed veterinarian of the Buyer's choice, at the Buyer's expense, within 72 hours of taking possession. If the veterinarian finds a serious pre-existing health condition, the Buyer may return the Puppy for a refund of the purchase price (minus the deposit) or, at the Seller's option, a replacement puppy. Failure to complete this examination within 72 hours voids this remedy.
5. HEALTH GUARANTEE
The Seller certifies the Puppy is in good health at the time of transfer, current on age-appropriate vaccinations and deworming as documented in the provided health record.
The Seller guarantees the Puppy for 2 years from the date of birth against congenital or hereditary defects that materially affect the dog's quality of life, as diagnosed in writing by a licensed veterinarian. This guarantee does not cover: conditions caused by injury, neglect, or improper care after transfer; parasites; infectious illness contracted after transfer; or conditions common to the breed that do not materially impair quality of life.
If a covered condition is diagnosed, the Seller will provide [A REPLACEMENT PUPPY / A REFUND UP TO THE PURCHASE PRICE / TERMS OF YOUR CHOICE]. The Buyer is responsible for providing veterinary documentation.
6. SPAY/NEUTER AND REGISTRATION
This Puppy is sold as a companion animal only. The Buyer agrees to have the Puppy spayed or neutered by 12 months of age (or as recommended by the Buyer's veterinarian) and to provide the Seller written proof from the performing veterinarian.
Registration paperwork, if applicable, will be provided on a LIMITED basis: the dog is registered, but offspring are not eligible for registration. Registration paperwork may be withheld until proof of spay/neuter is received.
The Buyer agrees not to breed the dog. If the dog is bred in violation of this section, the Buyer agrees to pay the Seller liquidated damages of $[PENALTY AMOUNT] per litter.
7. RETURN TO SELLER
If at any point in the dog's life the Buyer cannot keep the dog, the Buyer agrees to notify the Seller first. The Seller retains first right of refusal to take the dog back. The dog may not be surrendered to a shelter, rescue, or pound, or transferred to a third party, without the Seller's written consent. Refunds are not owed on returned dogs except as provided elsewhere in this agreement.
8. BUYER RESPONSIBILITIES
The Buyer agrees to provide the dog with appropriate food, clean water, shelter, routine and emergency veterinary care, and humane treatment for the dog's lifetime. The Buyer agrees to keep the dog under control and licensed as required by local law.
9. GENERAL TERMS
This agreement is the entire agreement between the parties and supersedes prior discussions. It is governed by the laws of the State of [STATE]. If any provision is found unenforceable, the remainder stays in effect. Any modification must be in writing and signed by both parties.

Common questions about breeding contracts
What should a puppy sales contract include?
The essentials: both parties' names, a full description of the puppy, price and deposit terms, a veterinary exam window (48 to 72 hours is standard), a health guarantee with clear coverage and remedies, spay/neuter and registration terms if it is a companion sale, a return-to-breeder clause, buyer care responsibilities, and signatures. Anything you would enforce later needs to be in writing now.
Are puppy contracts legally binding?
Generally yes, when the basics of a contract exist: offer, acceptance, payment, and terms both parties agreed to. Electronic signatures are valid under the federal ESIGN Act and state UETA laws. Enforceability of specific clauses varies by state, which is why a local attorney should review the contract you actually use.
Should a puppy deposit be refundable?
That is your call, but say it explicitly. Strictly non-refundable is common and defensible, since you turn away other buyers while holding a puppy. A popular middle ground is non-refundable but transferable to a future litter. Whatever you choose, state it in the contract and repeat it wherever you take deposits.
Is this generated contract legal advice?
No. It is a professionally structured starting point built from clauses breeders commonly use. Laws on health guarantees, deposits, and pet sales vary by state, and only an attorney licensed in your state can tell you how yours holds up. Generate the draft, make it yours, then have it reviewed.
Can BreederBuddy fill in and send contracts for me?
Yes, and this is where contracts stop being a chore. BreederBuddy includes starter contract presets (purchase, deposit, health guarantee, spay/neuter, co-ownership, stud service) that auto-fill the buyer, puppy, price, and kennel details from your records. The buyer e-signs in their private portal and the signed PDF is stored permanently. See the built-in templates →
